Chuck Jones, one of the better paid executives, had a bad week. As noted in our previous newsletter, the FirstEnergy CEO begged his friends in the Trump Administration to bail him out, even though they said “no” three times before.

Oh yeah, he also announced the closure of some of his largest assets and declared bankruptcy for FirstEnergy Solutions.

--> Another subsidy ploy Chuck has been threatening for months to close three nuclear reactors since these old units can’t compete against natural-gas-fired generators and wind farms. So the announcement to close the plants, including two in Ohio, was less a shock than another subsidy search.

Likely frustrated that his nuclear bailout bills – seeking some $4 billion – were gaining no traction in the Ohio legislature, Jones upped the ante, suggesting the newly promised plant closures would damage the state’s economy. Then he revealed his real lobbying motive: "We call on elected officials in Ohio and Pennsylvania to consider policy solutions that would recognize the importance of these facilities.” 
 
The Counting Crows once sang: “Believe in me. Help me believe in anything.” In trying to redefine a subsidy, it seems this Mr. Jones is deploying the same begging tactic on any willing listener. Playing the bankruptcy card Jones topped off his week with a blockbuster announcement that he saved for nearly midnight on the second night of Passover and the night before Easter. Something to hide there, Chuck?

FirstEnergy's subsidiary, FirstEnergy Solutions, is declaring bankruptcy. The company has been making bad business decisions for years, such as buying more coal plants just as natural gas prices were dropping. There was also the 2014 decision to spend $600 million to replace the steam generators at the Davis-Besse nuclear plant, followed by obtaining a 20-year extension for the plant’s operating license – only to announce the plant will close in just a few years. As a result, FirstEnergy Solutions has amassed enormous debt – more than $2.8 billion owed to creditors. The first payment of $100 million was due today, which the bankruptcy announcement puts on hold.

Even though the parent company and its subsidiary have long mixed their finances, Chuck is now trying to pretend they never met. His goal seems to be: Make the bankruptcy court and the federal government somehow believe the parent company shouldn’t be stuck with its subsidiary’s responsibilities. In addition to the $2.8 billion owed to creditors, the FirstEnergy team faces massive costs associated with decommissioning its nuclear reactors and cleaning up its coal-ash and other pollution.

Chuck seems to think taxpayers, consumers, or creditors – anyone but him – should cover his mistakes. The last word Despite poor strategic decisions, ill-timed investments, a $6 billion loss in 2016, a $4 billion dollar bankruptcy filing last weekend, power-plant closures, and responsibility dodging, Mr. Jones is rewarded with $14 million in salary. And this is no April Fools’ joke.

What a week! Through bankruptcy declaration, reactor closures, and subsidy pleas, FirstEnergy showed its conniving colors. 

So much going on, we’re bringing you two back-to-back newsletters. Let’s start with how the utility giant won’t stop trying to get an expensive bailout for its uneconomic power plants. It seems to be taking Aaliyah’s advice a little too seriously.

--> Memory loss FirstEnergy’s latest begging is its most shameless attempt yet.

Remember last summer, when FirstEnergy wanted a hefty sum of money for its uneconomic power plants, so it got its buddy Murray Energy to ask the U.S. Department of Energy (DOE) for a lifeline – in the form of an emergency order? And the DOE swiftly rejected the proposal?

Remember earlier this year, when a spokesperson for the DOE said it would **NEVER** use an emergency order to support money-losing power plants (emphasis ours)?

Well, late last week FirstEnergy submitted a baffling, brazen request to the DOE…to get an emergency order to save its uneconomic power plants. And all of the ailing coal and nuclear plants in PJM’s vast grid-operator region.

It appears FirstEnergy is suffering from memory loss. That, or the utility giant thinks everyone else is. “No emergency” FirstEnergy’s request included some harsh burns for PJM, the grid operator responsible for keeping the lights on across 13 states and Washington, D.C.

Specifically, the utility accused PJM of being unprepared for the impending doom that is sure to befall the whole world if FirstEnergy’s plants go offline.

PJM fired back with an unequivocal message: “This is not an issue of reliability. There is no immediate emergency.” The Public Utilities Commission of Ohio also shot down FirstEnergy’s message by issuing this statement: "There is no reason for customers of [FirstEnergy Solutions] - or anyone else in Ohio - to be concerned about whether or not they will have electricity. They will."

But who should we trust: The money-grubbing power company or the independent, non-profit agencies comprised of experts (whose entire jobs are to ensure the regional grid is reliable and to protect Ohio utility customers)? Quotes of the week It’s not just enviros and grid operators who are sick of FirstEnergy’s shenanigans.

The American Petroleum Institute had this to say:
  • “FirstEnergy needs to stop misleading the public […]For FirstEnergy to cry wolf on the issue of grid reliability is irresponsible and is the company's latest attempt to force consumers to pay for a bailout.”
And the Electric Power Supply Association, the national trade association representing independent power producers, delivered this memorable line:
  • “FirstEnergy Solutions’ letter lays a rotten egg when it comes to consumers, competitors and energy policymakers, both federal and state.”
Vox energy reporter, David Roberts, summed it up well:
